MEDAN, Waspada.co.id – Legal Counsel (PH) Johni alias Apin BK denied the charges of the Public.
Landen Marbun, attorney for Apin BK, explained that his client is not an operator or owner of an online title. Because, his client is just a person who rents to a person named Charles.
“From the BAP (investigation minutes) that we read as well as the results of the statements of witnesses who were examined at the previous trial on Tuesday, February 7 with 15 defendants (separate cases) it was revealed the legal facts that our client only rented a place (building) Warna Warni which is located in the Cemara Asri Housing area to brother Charles (DPO) as the operator or who controls the online gambling” he told journalists, Tuesday (14/2).
Not only renting out a place, Landen said his client also received a fee of 2 percent of Charles’ total online gambling turnover every month.
“Our client only rents the place to Brother Charles (DPO) every month for IDR 250 million. There was also a promise that brother Charles would give 2 percent profit from turnover. But not the 20 percent according to the prosecutor’s indictment,” he said.
“So the stigma that refers to our clients as bookies or online gambling bosses is not appropriate and only puts our clients in a corne,” he explained.
Therefore, his party will prove that the prosecutor’s indictment, which stated that Apin BK was the online gambling boss, was incorrect or wrong.
“We’ll see about that in the next trial” explained Hisar M Sitompul SH (Purn) Sunari, Bornok Simanjuntak, Rinaldo Butar Butar, Yan Iwan Robert Tambunan, Polmar LumbanGaol, and B. Budy Manullang.
Based on the BAP from the North Sumatra Police, continued Landen, Apin BK and Eric William only received a 2 percent fee for their clients.
“Apin only gets a 2 percent commission and even then only five rooms. The remaining 12 rooms only get rent. Nico’s BAP at Polda on August 25 that Apin BK only rented a room,” he explained.
The rent for the space in the colorful shophouses only lasts from April to August 2022.
“While Apin BK has never been involved in business at KMC. Not only recognition from Apin BK, but facts and investigative evidence from Nico and Eric Wiliam and 15 other operators while at Polda,” he said.
Previously, the prosecutor Frianta Felix Ginting in the indictment explained that the case began in November 2021. Apin BK together with Niko Prasetia, Eric Willian (separate prosecution) and Didi, Charles, and Hartanto Sugeng alias Atung and Alfredo (not yet caught) committed acts without permission provide opportunities for gambling games.
“The defendant provided an operational place for online gambling games in the Krakatau Multi Center (KMC) Medan warehouse complex which consists of 19 rooms used for online gambling game for bookies or online gambling website owners” said prosecutor Felix, Monday (13/2).
The prosecutor further outlined his indictment, in order to increase turnover, in January 2022 Apin BK purchased a four-door and three-story shophouse building located in block G-1 Numbers 53, 55, 57 and number 59 in the Cemara Asri Ressidence.
After being purchased by the defendant, each of the 10 rooms was then used as an operational place for online gambling games. The defendant provided facilities such as chairs, tables, computers, then CCTV and internet network in each room installed by Didi (not yet caught).
All of these facilities are used by online bookies to operate online gambling games, including witnesses Niko Prasetia (an online gambling shareholder) and Eric William, as the leader. (wol/bin)
